1. About these terms

These Terms of Service ("Terms") govern your access to and use of the website, training programs, workout content, and related services (the "Service") operated by NextLevel Athlete. By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, you must stop using the Service.

2. Who you are contracting with

You are contracting with NextLevel Athlete. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. You must be of legal age to form a binding contract (in most places, at least 18 years old, or the age of majority with parental consent where permitted) to use the Service.

3. The Service

NextLevel Athlete provides personalized training programs, workout libraries, progress tracking, and community features designed for high-school and developing athletes. Programs and workouts are educational in nature and are not medical advice. Always consult a qualified professional before starting any new exercise program.

4. Your account and responsibilities

  • You must provide accurate information when registering and keep it up to date.
  • You are responsible for keeping your account credentials confidential and for all activity under your account.
  • You must notify us promptly of any unauthorized use of your account.

5. Acceptable use

You must not misuse the Service. Without limiting the foregoing, you agree not to:

  • Use the Service for any unlawful purpose, or in violation of any applicable law.
  • Commit fraud, spam, or deceptive practices.
  • Infringe the intellectual property or privacy rights of others.
  • Interfere with the security of the Service, including introducing malware, probing for vulnerabilities, or scraping content in ways that harm the Service.
  • Reverse engineer, decompile, or attempt to extract source code, except as permitted by law.
  • Resell, sublicense, or redistribute access to the Service without our written consent.
  • Circumvent any technical limits, paywalls, or usage restrictions.

6. Content and intellectual property

The Service, including its software, workouts, programs, documentation, and branding, is owned by NextLevel Athlete and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial athletic training, within the limits of your selected plan.

Any content you post to community features (such as posts or comments) remains yours. By posting it, you grant NextLevel Athlete a limited, royalty-free license to host, display, and process that content solely to provide the Service. You are responsible for ensuring you have the rights to post any content you submit, and you must not post content that is unlawful, infringing, abusive, or otherwise violates these Terms.

7. Subscriptions, payments, and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Free, Pro, and Elite plans are offered on a monthly or yearly basis. Payment, billing, tax, cancellation, and refund mechanics are handled by Paddle under its Buyer Terms. Prices are shown in USD and may be displayed in your local currency at checkout with any applicable taxes added by Paddle.

Subscriptions renew automatically at the end of each billing period until canceled. You can switch plans at any time; any difference in price is charged or credited immediately. If you cancel, you keep access until the end of your current billing period, after which your account returns to the free plan. For refunds, see our Refund Policy.

8. No service guarantee

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components, or that any content is accurate, complete, or suited to your particular situation.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, NextLevel Athlete disclaims all implied warranties, including merchantability and fitness for a particular purpose. In no event will NextLevel Athlete be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill.

Our aggregate liability for any claim arising out of or related to the Service is limited to the total fees you paid us in the six months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, or pose a security or fraud risk. Upon termination, your right to use the Service ends. You may stop using the Service and cancel your subscription at any time through your account settings or by contacting Paddle.

11. Indemnity

You agree to indemnify and hold NextLevel Athlete harmless from claims, damages, and expenses arising from your content, your unlawful use of the Service, or your violation of these Terms.

12. Changes to the Service and Terms

We may update or change the Service and these Terms from time to time. Material changes will be posted here with an updated date. Continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which NextLevel Athlete operates, without regard to conflict of law principles. You and NextLevel Athlete will try in good faith to resolve any dispute informally. If that fails, disputes will be resolved in the courts of that jurisdiction.

14. Assignment and force majeure

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Neither party is liable for failure or delay due to events beyond reasonable control.
